Biosolids: Public Comment on EPA Draft Guidance for Reducing PFAS in Biosolids

AVFCA Commentary: On behalf of A Voice for Choice Advocacy, a nonprofit organization dedicated to scientific research, public education, and the protection of individual rights when it comes to what we put in our bodies and what we allow into our environment. We submit these comments on behalf of our organization and the thousands of Californians and Americans who depend on us to speak up when their health and their rights are at stake. We want to begin by thanking the Environmental Protection Agency for acknowledging what many of us have known for years: PFAS in biosolids pose serious risks to human health and the environment. The draft guidance before us represents a step in the right direction. But we must be direct with you. Guidance is not enough. Voluntary measures will not protect our families, our farmers, or our food supply. What we need, and what we are here to demand, are enforceable federal standards that actually prevent contamination rather than simply documenting it after the damage is done.

Bill Name: Biosolids: Reducing Risk from Perfluorooctanoic Acid and Perfluorooctane Sulfonic Acid
Bill Number: EPA-HQ-OW-2026-2509
Bill Author(s):
Legislative Session / Year: 2026
State: Federal
AVFCA Position: Watching
Bill Synopsis: The Environmental Protection Agency (EPA) is making available a draft memorandum that, if finalized, would provide guidance to operators of wastewater treatment plants (WWTPs) and related facilities, landowners and farmers, state and Tribal water agencies, and the public on potential ways to reduce risk posed by perfluorooctanoic acid (PFOA) and perfluorooctane sulfonic acid (PFOS) in biosolids, as well as seeking feedback on the potential next steps. The EPA is soliciting public comments on the draft memorandum and next steps. This draft guidance document does not have the force and effect of law, nor does it bind the public in any way. The intent of the draft guidance memorandum is to provide non-binding or voluntary recommendations for how to mitigate risks from PFOA and PFOS in sewage sludge and biosolids based on information currently available to the EPA.
